ART. 1 - Applicability
These terms and conditions apply to all goods or services supplied or provided by our company.
ART. 2 - Electromagnetic compatibility and safety
We certify that our goods meet the applicable electromagnetic compatibility and safety standards; any obligatory declarations are contained in detail on the plates or labels applied to our products, as well as in the technical documentation accompanying the products or available from us. The recipients of the goods or services are required to use or sell the goods ensuring that they are intact, complete and that this information is usable.
ART. 3 - Warranties
The goods and services supplied or provided by us are guaranteed for a period of 12 months. The term of the warranty becomes effective on the date of manufacture of the product or upon completion of the services requested. The warranty is strictly limited to the normal working order of the product supplied and the result of the service provided. Products supplied are restored to normal working order at our company site.
Our company does not accept responsibility for the working order of goods supplied operating in environmental or technical conditions that differ from our specifications and which are described in the technical documentation.
We are not liable for any damage directly or indirectly not caused by the malfunctioning of the product.
The buyer will no longer be covered by the warranty in case of buyer's default in the payment of the price.
The guarantee will not be applied in the following cases:
- Tampering of the label with the serial number of the machine.
- Damage or breakage caused by transport.
- Damage or breakage caused by vandalism, natural disasters or malicious actions.
- Wrong installation or misinstallation of the product.
- Unsuitable or anomalous electric plants.
- Carelessness, negligence or incompetence in the use of the product.
- Non-compliance with the operating instructions.
- Interventions for presumed defects or convenient checks.
- Unauthorized interventions on the product.
Any interference or tampering with the goods supplied by unauthorized persons will be cause for the immediate revocation of the warranty.
We hereby declare that we have taken careful consideration, to the best of our knowledge and manufacturing practices, to the problem of goods supplied being violated by parties who intentionally alter their normal working order. Nevertheless, we do not accept responsibility for illegal conduct or damage that may result from the fraudulent use of the goods supplied.
ART. 4 - Delivery
The goods supplied are considered delivered upon arrival at the shipper's or carrier's site; our company does not accept responsibility for total or partial theft, damage or delays connected to the transportation of the goods. The recipient is responsible for scrupulously noting any discrepancies immediately encountered with the goods supplied on the shipping document upon delivery. Refusal by the purchaser to accept or withdraw the goods ordered in full or in part does not terminate the obligation to pay for them.
ART. 5 - Ownership
The goods supplied are considered the property of our company until we receive full payment for the agreed price.
ART. 6 - Returns
Returns of defective goods or as a result of servicing must be specifically authorized by us. We therefore reserve the right to reject the returned material or provide you with a return location other than our office. We assume responsibility for returned goods only upon delivery to the address specified by us.
ART. 7 - Applicable law; court of justice
The goods and services covered by these terms and conditions are governed by Italian law.
All disputes will be settled in the court of Milan only.
